Can I recover money I invested in a company?

Question:

I sold property and invested into a company. Unfortunately, the company failed. Can the money invested be recovered in any way? When I sell something in the future can capital gains tax (CGT) be offset? Can any deductions be made on my normal income tax returns? The answers to these questions would really help me in deciding if I should put my current properties into a new company, with the CGT offset for the past loss.

If you take a look at HMRC’s Capital Gains manual it indicates that if someone lends money to a trader, and the money is lost, it can create a capital loss. It is quite likely that this loss can be carried forward and used to offset against a future capital gain. Of course, there are rules and conditions that need to be met. See HMRC’s guidance at CG15830, CG15831 and CG15800.
