Adding a spouse as a joint owner – tax issues

Question:

Are there any tax implications if a wife adds her husband as joint owner in a house (without mortgage) in England? Does she need a solicitor to apply for this?

Arthur Weller replies:

As long as the couple are living together, there are no capital gains tax implications if a wife adds her husband as joint owner of her house. And if there is no mortgage, there are no stamp duty land tax implications. Most people would ask a solicitor to do this for them, but if you are sufficiently competent to handle the 'paperwork', you can do this yourself.
